Terms of Service

These Terms of Service ("Terms") govern your access to and use of pegaseperfume.com and any purchase of products from Pegasé Perfumery. By using the site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction (whichever is greater), to purchase from Pegasé. Fragrance products contain alcohol and other regulated ingredients; we reserve the right to refuse or cancel any order that we suspect violates this requirement.

2. Your account

You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms.

3. Products, descriptions & pricing

We make every effort to display our perfumes — including notes, colors, and bottle imagery — as accurately as possible. Slight variation between batches is inherent to artisan fragrance and is not a defect. All prices are listed in U.S. dollars and may change without notice. In the event of a pricing error, we reserve the right to cancel any affected order and issue a full refund.

4. Orders

Your order is an offer to purchase. We accept your offer when we send the order confirmation email. We reserve the right to refuse, limit, or cancel orders at our sole discretion, including for suspected fraud, age violations, shipping restrictions, or stock availability.

5. Payment

Payment is processed by Stripe, Inc. Pegasé does not see or store your full card number. By submitting payment information you authorize the charge and confirm you are the cardholder or have the cardholder's permission to use the card.

6. Shipping

Shipping terms, processing time, and carriers are described on our Shipping Policy page, which is incorporated by reference. Risk of loss passes to you when the carrier accepts the package.

7. Returns & refunds

Our return and refund terms are described on our Refund & Return Policy page, which is incorporated by reference. Opened fragrance bottles are not returnable for hygiene and safety reasons.

8. Intellectual property

The Pegasé name and logo, the website design, photography, product names, copy, and the meteor visual system are owned by Pegasé Perfumery and protected by copyright, trademark, and other applicable laws. You may not copy, reproduce, modify, or use any of this content without our prior written permission, except for personal, non-commercial use of the site.

9. Disclaimers

Fragrances contain alcohol, fragrance oils, and other ingredients that may cause allergic reactions in some individuals. We list ingredients on each product page and on the bottle carton; please review them before use. Pegasé makes no representation that any product is suitable for any specific person. Discontinue use immediately if you experience irritation and consult a healthcare professional.

The site and products are provided "as is" and "as available," without warranties of any kind, express or implied, except those that cannot be excluded under applicable law.

10. Limitation of liability

To the fullest extent permitted by law, Pegasé Perfumery, its owners, employees, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the site or any product, including lost profits, lost data, or damage to property. Our total liability for any claim related to a product will not exceed the price you paid for that product.

11. Indemnity

You agree to defend, indemnify, and hold harmless Pegasé Perfumery from any claim, loss, liability, or expense (including reasonable attorney's fees) arising from your violation of these Terms or misuse of our products or site.

12. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in Fresno County, California, and you consent to personal jurisdiction there.

13. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Continued use of the site after changes are posted constitutes acceptance of the new Terms.
